These Terms of Service govern the access to and use of the website www.tradeyouup.net, the Trade You Up platform, and its related features, collectively referred to as the "Services."
By creating an account, subscribing to a plan, or using the Services, you declare that you have read and agree to these Terms. If you do not agree, do not use the Services.
1. About Trade You Up
Trade You Up is a platform for recording, organizing, and analyzing trading operations.

The Services are intended for individuals at least 18 years of age with legal capacity to enter into contracts.
2. Nature of the Services
Trade You Up offers tools that may include:
- recording and organizing trades;
- trading journal;
- adding images, notes, strategies, and evaluations;
- generating statistics, charts, scores, and reports;
- analysis of discipline, execution, risk management, and performance;
- other features related to tracking trading activity.
Available features may vary according to the contracted plan.
We may update, improve, replace, suspend, or discontinue features, provided that the user's rights under applicable legislation are respected.
3. Trade You Up Does Not Provide Financial Advice
Trade You Up is a recording, analysis, and educational support tool.
We are not a broker, financial institution, investment advisory, asset manager, or trading signal provider.
No information, statistic, score, chart, report, or content provided by the platform constitutes:
- a recommendation to buy or sell;
- financial or investment advice;
- a promise or guarantee of results;
- a solicitation to carry out a particular operation.
All investment decisions are the sole responsibility of the user. Trading and investments involve risk and may result in partial or total loss of capital.
Past results do not guarantee future results.
4. Registration and Account Security
To use certain features, you must create an account and provide true, complete, and up-to-date information.
You are responsible for:
- keeping your password and credentials confidential;
- preventing unauthorized use of the account;
- immediately reporting any suspected unauthorized access;
- keeping your email address up to date;
- being liable for activities carried out through your account, except when resulting from a failure attributable to Trade You Up.
The account is personal and may not be sold, transferred, or shared with third parties.
We may request identity or account ownership confirmation when necessary for security, support, or compliance with legal obligations.
5. Permitted Use
You agree not to:
- use the Services for illegal, fraudulent, or abusive activities;
- access accounts, systems, or data without authorization;
- introduce viruses, malicious code, or mechanisms intended to harm the platform;
- attempt to circumvent security measures or technical limitations;
- copy, modify, resell, or commercially exploit the platform without authorization;
- reverse engineer, extract source code, or reproduce substantial portions of the Services, except as permitted by law;
- use automated systems to collect data or overload the infrastructure;
- insert content that violates third-party rights;
- use another person's account or allow third parties to use yours.
We may limit or suspend access when there are reasonable indications of fraud, security risk, abuse, or violation of these Terms.
6. User Content and Data
You remain the owner of the trades, images, notes, strategies, and other content you enter on the platform.
By submitting such content, you grant Trade You Up a limited, non-exclusive license, valid only for the time necessary to store, process, display, and use the content for the purpose of providing and improving the Services.
You declare that you have the necessary rights over the submitted content and agree not to include:
- illegally obtained information;
- protected content that you are not authorized to use;
- broker passwords or access keys;
- third-party personal data without authorization;
- documents or information whose inclusion violates confidentiality obligations.
User data will be processed in accordance with our Privacy Policy.
7. Subscriptions and Payments
Some features are offered through paid subscriptions.
Before subscribing, the following will be informed:
- the chosen plan;
- the price and applicable taxes;
- the subscription duration;
- the billing frequency;
- the main included features;
- renewal and cancellation conditions.
Unless otherwise indicated, subscriptions may be automatically renewed at the end of each period. Billing will be charged using the registered payment method.
The user is responsible for keeping payment details up to date.
We may change prices for future periods, with reasonable prior notice. The change will not affect the period already paid.
In the event of payment failure, access to paid features may be limited or suspended.
8. Free Trial, Cancellation, and Withdrawal
When offered, the free trial period will be subject to the conditions presented at the time of subscription.
You may cancel the subscription renewal through account settings or by contacting us at support@tradeyouup.net.
Cancellation prevents future charges, but access may remain available until the end of the period already paid.
When applicable, consumers residing in the European Union may exercise the legal right of withdrawal within 14 days of subscribing.
If the user requests immediate access to the service during this period, we may request your express consent for the start of the service. The amount due or the right to a refund will be determined according to the nature of the service used and applicable legislation.
Except in cases required by law or expressly offered by Trade You Up, payments for periods already used will not be proportionally refunded.
Nothing in this section limits mandatory consumer rights.
9. Availability and Changes to the Services
We work to keep the Services secure and available, but we do not guarantee uninterrupted or error-free operation.
Access may be temporarily affected by:
- maintenance;
- updates;
- technical failures;
- provider unavailability;
- internet issues;
- events beyond our reasonable control.
Whenever possible, we will communicate relevant interruptions and restore the service within a reasonable timeframe.
If a change significantly affects an essential feature of a paid subscription, the rights provided under applicable legislation will be respected.
10. Intellectual Property
The platform, its software, visual identity, logos, texts, designs, databases, features, and proprietary content belong to Trade You Up or its respective licensors and are protected by intellectual property legislation.
Subscribing to a plan does not transfer any ownership rights of the Services to the user.
Only a personal, limited, revocable, non-exclusive, and non-transferable license is granted to use the Services during the account's validity and in accordance with these Terms.
11. Third-Party Services
The platform may use or offer integrations with third-party services, such as:
- payment processors;
- hosting services;
- analytics tools;
- authentication platforms;
- brokers, trading platforms, or data importers.
These services may be subject to their own terms and policies.
Trade You Up does not control or assume responsibility for the availability, security, or operation of external services, without prejudice to liabilities that cannot be excluded by law.
12. Suspension, Termination, and Account Closure
You may stop using the Services and request account deletion at any time.
Deletion may result in the permanent loss of stored trades, statistics, images, reports, and notes. We recommend that you previously export the data you wish to keep, when this feature is available.
We may suspend or terminate an account when there is:
- serious or repeated violation of these Terms;
- fraud or illegal activity;
- risk to the security of users or the platform;
- non-payment;
- legal obligation or order from a competent authority.
Whenever reasonably possible, we will inform the reason and offer an opportunity for remediation or dispute.
Provisions regarding intellectual property, liability, pending payments, and dispute resolution will remain applicable after termination.
Accounts that remain inactive for more than 30 days without the user having registered any trades may be deleted without prior notice, unless the user has an active paid plan.
Accounts that remain inactive for more than 90 days may be deleted without prior notice, unless the user has an active paid plan.
13. Warranties and Liability
The Services are provided in accordance with the features described on the platform and subject to the mandatory warranties provided by applicable legislation.
Trade You Up does not assume responsibility or guarantee:
- profits or financial results;
- performance improvements;
- absolute accuracy of statistics;
- compatibility with all brokers, platforms, or devices;
- total absence of failures or interruptions;
- that the data entered by the user is correct.
The user is responsible for verifying their records, statistics, and information before making any decision.
To the maximum extent permitted by law, Trade You Up will not be liable for trading losses, lost profits, missed opportunities, or investment decisions made based on the platform.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, personal injury, fraud, violation of mandatory consumer rights, or other liabilities that cannot be legally excluded.
14. Changes to These Terms
We may update these Terms to reflect legal, technical, commercial, or platform feature changes.
The updated version will be published on this page with the new update date.
Relevant changes will be communicated with reasonable advance notice by email or through the platform, when required or appropriate.
If you do not agree with a relevant change, you may cancel your subscription and stop using the Services before it takes effect.
15. General Provisions
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.
The failure to exercise a right will not be considered a waiver.
The user may not transfer their account or contractual rights without authorization from Trade You Up. Trade You Up may transfer the contract in the event of corporate reorganization, sale of the business, or equivalent operation, respecting the user's rights.
These Terms, together with the Privacy Policy and the conditions presented at the time of subscription, constitute the agreement between the user and Trade You Up regarding the Services.
